Riding the 475-kilo horse, followed closely behind by a paying guest on another horse, Jayne headed out towards the Rio Seco, not realising the nightmare which was about to be unleashed.
As the pair of horses walked along a cement-covered section of road towards the river, without warning Jayne’s horse collapsed onto the concrete surface, trapping her beneath. With the horse unable to get to its feet, the guest rider could only watch on in horror as the animal writhed around in panic before regaining its footing.
The horrifying accident only lasted a matter of seconds but left Jayne with her tibia shattered and exposed through her shin. With her shoulder dislocated and with only her riding jodhpurs holding the bone in her leg in place, Jayne held onto the panicked animal’s reins until help arrived fifteen minutes later. Four local men who happened to be driving by and lifted her into a friend’s car and off to the Costa del Sol A&E ward.
She was released six days later, wheelchair bound and needing daily injections and medical care, with her leg pinned and plated and a prognosis of six months immobilisation followed by painful physiotherapy.

MALAGA Public Prosecutor’s Office is asking for 18 years in prison for three people charged with defrauding Marbella Town Hall in 2003.
One of the accused was the head of the Parks and Gardens Department. All three are believed to have pretended to carry out work and services for the town hall and received public funds for doing nothing.

Spanish government appealed for calm from investors
The Spanish government appealed for calm from investors on Wednesday following a downgrade in its credit rating, a day after similar downgrades for Greece and Portugal sent shockwaves through the markets.
S&P said it was lowering Spain's long-term sovereign credit rating by one notch to "AA" from "AA+" because the country was "likely to have an extended period of subdued economic growth, which weakens its budgetary position."
The agency also said its outlook for Spain was negative and the country could face another downgrade in a statement that sent the euro plunging to a one-year low against the dollar and European stock markets tumbling.
Markets are especially sensitive to Spain's fiscal situation because of the size of its economy, which is Europe's fifth largest. European banks also have far greater exposure to Spanish debt than to Greek or Portuguese debt.
S&P downgraded Greece's bonds to junk status on Tuesday and cut Portugal's long-term credit rating by two notches, causing the markets to plunge on fears that the debt debacle in Athens was spreading to other eurozone countries.
"The downgrade of Spanish government debt by S&P is another alarming sign that the effects of the Greek crisis are spreading," said Ben May, European economist at London-based market research firm Capital Economics.
Phil McHugh, a dealer at forex trading company Currencies Direct, said the contagion from the Greek financial crisis would likely spread to other nations on the fringe of the euro zone that are also burdened by big deficits.
"We could now see this contagion filtering through to Ireland and Italy" after Portugal, Greece and Spain, he said.
Spain's Deputy Prime Minister Maria Teresa de la Vega said the government was taking the measures needed to bring the public deficit down from 11.2 percent of gross domestic product to within a 3.0-percent limit set for the 16 nations that use the euro by 2013.
"We are adopting all the measures needed to meet our commitments," she told reporters in parliament shortly after S&P Spain's credit rating.

"While commercial property prices have started to rebound in some European countries, this is likely to have had only a modest beneficial effect on bank asset quality," said S & P credit analyst Giles Edwards.
"In our view banks in the UK, Ireland and Spain in particular will likely continue to support elevated impairment losses on commercial real estate loans through 2011."
The most heavily exposed banks could see their credit ratings adversely affected, the report said.

Spain and Portugal had their credit ratings cut this week in the wake of Greece's spiralling debt crisis but analysts said the fiscal situation in the two countries is far from that faced by Athens.
"Spain and Portugal's capacity to meet their payments are not being questioned," as is the case for Greece, which faces key debt deadlines, Fernando Fernandez, an economist at the IE Business School in Madrid, told AFP.
Spain's unemployment rate rose to 20.05 percent in the first quarter, from 18.83 percent in the fourth quarter of 2009, the national statistics office INE said Friday.
The number of jobless soared 286,200 in the three months to March over the previous quarter to reach 4,612,700 people, it said in a statement.
The last time the unemployment rate topped 20 percent in Spain was in the fourth quarter of 1997 when it hit 20.11 percent.
The first quarter unemployment figure confirms the number which had been posted in error by INE on its website at the beginning of the week.
Spain's jobless rate has soared since the global credit crisis hastened the collapse of its labour-intensive construction industry at the end of 2008.
The country has the highest unemployment rate in the 16-nation eurozone and accounts for half the region's job losses over the last two years, according to the European Union's statistics office Eurostat.

Property tax reclaim in Spain property Capital Gains Tax
European Court obliges Spanish Government to refund property Capital Gains Tax. If you sold your property in Spain between 1997 and 2006 you could be entitled to reclaim thousands of pounds back.Capital Gains Tax on property sales that took place prior to the 31st of December of 2006 was charged at a tax rate of 35% for non residents, whereas residents were charged at a lower 15% tax rate. This disparity has been deemed discriminatory for European Union citizens by the EU Commission with Spain being cautioned on this issue.
It is considered that the different tax treatment of the two categories of tax payers, in so far as it results in a higher tax burden on non-resident individuals in situations objectively similar to those of residents, constitutes indirect discrimination on the grounds of nationality prohibited by the Treaty.
Under the threat by the EU to impose sanctions (Infringement procedure of the European Commission against Spain for the tax treatment of Capital Gains Tax for nonresidents) the Spanish Government modified the Tax Laws with effect from the 1st of January 2007 onwards.
But this doesn’t change the underlying issue of the prior discrimination in the treatment received by EU citizens non resident in Spain. Furthermore, a regional High Court has upheld this argument and issued judgement ruling that the overpayment infringes the European Treaty and the diverse tax rates obey solely to the different nationalities of the tax payers, imposing a higher tax burden on foreigners, constituting discrimination prohibited by this European Treaty. Although not binding, this judgement is good evidence of the strength of the case.
Consequently, citizens of the UE who sold a property in Spain before the 31st of December 2006 whilst non tax resident in Spain may be entitled to file a claim to obtain reimbursement of the overpayment of the Capital Gains Tax. Albeit it is imperative to act quickly since there is a statute of limitations to take action. Dead line: November 2.010.

organized crime group operating in Malaga
National Police has arrested nine members of an organized crime group operating in Malaga and Alicante. The suspects, of four different nationalities (Moroccan, Romanian, Moldavian and Spanish) all aged between 20 and 39 are thought to be responsible for an armed robbery in a Jewllers in Malaga and four violent robberies in Alicante, three in private homes and one a local business.
Investigations began in October 2009 and culminated with the arrest of the nine men in Elche, Crevillente and Los Montesinos. The suspects where found to be in possession of some of the stolen goods as well as tools and devices used to commit the crimes.

“Please be advised that during the two weeks that the office has been sealed off and described as a crime scene, neither the Gibraltar Police nor any other authority in Gibraltar have seen fit to interview the staff. In circumstances where neither the partners of the law firm nor the Provisional Liquidators have spoken to staff officially as to whether they are to be made redundant or not and as to whether they will be paid at the end of this month or not, the staff are in a dreadful situation and some of them face immediate financial hardship as a result of this sordid affair.

Last week Unite the Union got involved on behalf of the Marrache staff. It emerged it is in discussions with the Employment and Training Board regarding the fate of up to 50 employees. District Officer Charlie Sisarello told the Gibraltar Chronicle there were complex matters to be resolved and grey areas such as the entitlements due to self-employed workers – furthermore they had not received their January salary let alone been paid for last month.
Sisarello said: “…all the staff members of Marrache who are members of Unite attended a meeting where our lawyers and officers informed them of the current situation in respect of their employment status. At present the staff is in limbo and their situation needs to be clarified so the necessary mechanisms that allow for a claim to the Insolvency Fund can be put in place. They are technically employed still but without being able to work. On the other hand they have not been dismissed or made redundant. It is fundamental that their situation is clarified. As any group of workers, these union members have financial commitments to attend to, apart from having to pay their domestic bills and household expenses. A solution needs to be addressed urgently as this is obviously causing much concern to them. We will be doing our utmost to get a viable solution and will be working closely with our lawyers towards this objective.”
The fact that Unite is fighting for the employees living in Gibraltar is to be welcomed and the fact it has asked utility companies to hold back on demanding payments is all well and good - but those who live in Spain and Portugal have been hung out to dry!
I should stress that whilst I raised the question - were any Marrache staff involved in the corruption? - it was the financial and not the legal side of the firm that I was referring to. I have no reason to believe that the legal staff in the Gibraltar, Spain or Portugal offices behaved in other than an honest manner (I understand London was a franchise).
Having said that my column carried on the USA-based blog Dscriber attracted several comments from “Gibraltarians” which disparaged the Marrache practice and the three sons’ father. I have since read others on a UK legal website that spoke highly of the family, law firm with suggestions that the Marraches were the victim of some conspiracy. As with all such unattributed comments on the internet you pay no money and take your choice. Ultimately the truth will out but in the meantime the general Marrache staff need to be treated as victims and not culprits.

Police are hunting the killers of a British man stabbed to death with a kitchen knife at his Costa del Sol flat.
The 32-year-old Londoner was attacked in front of his girlfriend after opening his door to two men at Benalmadena. One of them stabbed him twice with the knife he pulled from a kitchen drawer.The victim was dead by the time paramedics arrived.

judge in Málaga has ordered the embargoing of one of the Ándalus airplanes because of the debts faced by the company.Last week the company announced they would be suspending their services from Gibraltar to Madrid, and plans to run to Barcelona and Bilbao, but it is now also known that one of their planes was impounded in Almería last Wednesday.It follows a demand from the Gecas company, who are the owners of most of the fleet rented by Ándalus. The company says that its current flights are continuing as normal, and the Spanish air safety agency AESA says they are watching developments closely but for now ‘safety is guaranteed’.

Four people have been arrested by police in connection with the stabbing of a Sevilla football fan in Málaga last Saturday. The attack happened close to the Rosaleda Stadium in Málaga before the game.The four detained face charges of taking part in a brawl and an attempted homicide, and have been named as 23 year old E.C.V., 32 year old J.A.C.C., and 33 year old J.J.B.R..The fourth man, 27 year old A.M.L. is considered to have carried out the actual stabbing. The injured man was treated at the scene and in hospital to a rib injury caused by the knife. Police are continuing to investigate the case and questioning fans from both clubs.

‘Over 90 percent of the people we see in the Costa del Sol Hospital have breathing disorders during sleep’, respiratory physician José Joaquín Cebrián said. It is a problem that increases 10 percent every year according to figures, in fact, since the Hospital started its Sleep Unit seven years ago.
‘We started doing some 200 studies per year and in 2009 we made 870. We could do more, but our technical teams are a little short’, Cebrián says.
‘The clearest symptoms of this disease include snoring, but also other respiratory pauses during sleep, and mainly, the daytime sleepiness and fatigue are’, the expert explains. He adds that multiple factors lie behind the disease. However, if one were to produce an ID to identify these patients, being overweight would be the main feature."

Guests are recommended to give up the most toxic offenders - such as caffeine, wheat, alcohol and red meat - at least two weeks before arrival.
But as the programme kicked off with a meet and greet, I started to worry about my rather relaxed attitude to the pre-cleanse guidelines compared to my comrades.
Each day began at 7am with body brushing and breakfast, before a taxing 90-minute yoga session led by Yair Sagy."

This is according to an article in Belgrade daily Blic this Thursday, which alleges that the Montenegrin-born fugitive who holds Serbian passport faced only one condition: that the drugs should not enter Montenegro, or be sold there. The daily quotes investigation data from Operation Balkan Warrior as the course of its allegations. The article also says that there was an agreement with Šarić that none of the ships carrying cocaine could dock in Montenegrin ports.
Šarić and his gang are suspected of attempting to smuggle 2.7 tons of cocaine from South America last year. The shipment was intercepted in the joint operation launched by police and intelligence agencies from Serbia, Europe, and the U.S. According to the Blic article, Šarić was shipping his cocaine to Mediterranean ports in Greece and Spain. An erroneous identification earlier on in the investigation led to the arrest of two Russian citizens who had nothing to do with the crime. One of these Russians, Dimitri Dergachev, who runs a well known disco in the Vega Baja, spent 48 hours behind bars, and was released on a bail of 3,000 euros. He is now undergoing psychological treatment to get over the shock of the whole situation.

The Hell’s Angels were arrested in the Valencia City of Torrent, Castellon and Murcia. It is believed that one of those arrested actually shot Martinez, when he refused to hand over the money he had in the office in the road Ramon Gallud. They are three Spaniards and one Russian citizen, one of whom is a female. A firearm was found when their homes were inspected. It will now be analysed to see if it is the one used in the robbery."

£80 ransom is being demanded for the phallus’s return

North Yorkshire shopkeeper has had a key piece of stock confiscated by North Yorkshire Police after it caused a string of complaints.Jason Hadlow, owner of Simply Dutch at Leeming Bar, has been issued with a public order offence and will face a fine if he wants to reclaim the garden ornament.Jason recently received a new range of garden furniture including a four feet penis-shaped obelisk which went on display in Simply Dutch’s window at the end of March.
Following complaints from local people, North Yorkshire Police visited the store, removed the offending ornament, worth in the region of £200, and issued Jason with a public order offence for ‘displaying a sign or item liable to cause harassment, alarm or distress.’
Jason must now pay £80 by Friday 9th April to retrieve the item from Northallerton Police Station, or could face court action. However, the entrepreneur, from Yarm, is refusing to back down stating that the phallus is in keeping with Simply Dutch’s quirky ethos and has even started a ‘Free Willy’ campaign in store and on Facebook.
Jason said: “The world is a crazy place and I'm sure the local constabulary has better things to do. It’s just another example of overzealous policing and I couldn’t believe they were serious. We might have had one or two complaints but most of the customers loved it as they know what Simply Dutch is like and the type of things we stock.
“We’ve had naked stone strippers, Roman and Greek-style statues, African pothouses and all sorts of other weird pieces of furniture in the window which haven’t caused such a stir. So I am a little shocked, to say the least, that an £80 ransom is being demanded for the phallus’s return.”

Romanian immigrant had an argument with his flatmate, the argument started in the living room of the flat in Marbella but moved into the kitchen where it quickly escalated into a violent attack.The accused allegedly plunged a kitchen knife into the flatmate’s chest, according to the prosecution, with the intent on “taking his life”.The victim suffered a punctured lung and a severed aorta which killed him.A request has been made for a 14 year prison sentence from the prosecution for murder and the sum of 200,000 euros to be paid as compensation to the victim’s family.

Former boss of Anglo Irish Bank has headed for the luxurious sanctuary of the Real Club de Golf Las Brisas Spanish golf and country club.
Mr FitzPatrick became a member of the exclusive club in Marbella several years ago, when joining fees were close to €100,000.Unconfirmed reports from staff working in the restaurant suggested that Mr FitzPatrick dined out with friends in the club restaurant on Thursday night -- just as the full horror of the impact of the crisis on present and future generations was becoming clear.The club is one of Mr FitzPatrick's favourite haunts on the sunshine coast. The restaurant boasts a five-star menu of lobster and prawn salad hors d'oeuvres garnished with pine-nut vinaigrette and apple chutney, for €22. For those with heartier appetites, there is beef Wellington, with mushrooms, truffle and puff pastry, at €22.
Mr FitzPatrick is understood to have holidayed at the Hotel de Las Golf resort, where apartments cost up to €1m at the peak of the boom.
"It's only natural he's going to stay where he'll be left alone in peace and quiet."
There were some rumblings however, from the strong Irish contingent at the club. As one regular said: "Some of my friends would have been big investors and they have been very badly hit. They are very fed up and I've been getting calls all week, asking where he is.
"They think he has a cheek, prancing around on holidays with the terrible mess he has left back home. They want to get their hands on him, they want to know where he is."
Another businessman, who is a director of one Ireland´s leading property agencies, said: "We're just all trying to keep a cool head. I'm holding my nerve.
"You have to stay calm. If you didn't," he said, putting a finger to his head to mimic a gun, " then we'd all be in the loony bin."
A neighbour of Mr FitzPatrick described how he is often seen enjoying the easy life at the Las Brisas club.
"You'd often see him dining with friends after a round of golf. He may be despised by everyone back home but he has a tight circle of friends in Las Brisas who have stayed loyal to him throughout.
"You don't abandon that kind of loyalty overnight. So it's a place where he can come to get away from it all."
A few miles away on the port, however, the mood towards the banker is a complete contrast -- full of anger and resentment.
In the back of the pub, a table of Irish businessmen loudly discussed the vilified banker.
"No one would have known him a year ago if he walked through that door, but now everyone has their own reasons for wanting to meet him," one of them smiled.
His friend agreed, saying: "I know people who used to be friends of his and who have lost a lot of money because of Anglo. They've all turned on him now. There are a lot of very sore people back home."

"I would regularly see him dining out in the restaurant," said a source. "He has some buddies in Las Brisas who have stayed very loyal to him throughout and I've seen them dining together, overlooking the course."It's only natural he's going to stay where he'll be left alone in peace and quiet."

"If he comes in here he will be lynched," he said. "At the very least, the first thing I'd do is throw my glass of red wine over him.
